SMS Terms of Service

1. Overview. Kajabi, LLC ("Kajabi," "we," "us," or "our") may offer one or more SMS and text messaging programs (each, a "Program") to Heroes and other users of the Kajabi Platform ("you" or "your"). These SMS Terms and Conditions ("SMS Terms") apply to all Programs and govern your receipt of text messages from Kajabi. By opting in to any Program, you agree to these SMS Terms. All capitalized terms not defined herein shall have the meaning attributed to them in Kajabi's Platform Terms of Service ("Platform Terms"), available at https://legal.kajabi.com/policies/terms.

2. Programs. Kajabi may send text messages related to your use of the Platform and the Services, including but not limited to: account notifications and alerts, milestone celebrations and congratulatory call notifications, transactional messages (such as verification codes, order confirmations, or payment alerts), product and feature announcements, tips, educational content, and event reminders, and any other messaging program for which you provide consent. Each Program will identify itself and its purpose at the point of opt-in. Kajabi reserves the right to add, modify, or discontinue Programs at any time, consistent with Section 14 (Modifications) of the Platform Terms.

3. Opt-In / Consent. You may be asked to opt in to a Program through various methods, including but not limited to: providing your mobile phone number and consentingon the Platform or within a Kajabi application, clicking a link or button in an email from Kajabi that initiates an SMS flow, replying with a keyword (such as CALL, YES, or JOIN) to a message from Kajabi, or any other consent mechanism that clearly identifies the Program and obtains your affirmative agreement. By opting in, you expressly consent to receive text messages from Kajabi at the mobile number you provide. Consent to receive text messages is not a condition of purchase of any Kajabi product or service or a condition of any other use of the Platform.

4. Message Frequency. Message frequency varies by Program and by your interactions with the Platform. Some Programs may send a limited number of messages tied to a specific event (e.g., up to 5 messages related to a single milestone celebration call). Others may send recurring messages over time. The expected message frequency will be disclosed at the point of opt-in for each Program.

5. Message and Data Rates. Message and data rates may apply. Kajabi does not charge you for SMS messages, but your mobile carrier's standard messaging and data rates will apply. Contact your wireless carrier for details about your text messaging plan.

6. Opt-Out. You can cancel messages from any Program at any time. Text STOP to the number from which you received a message. After you send STOP, you will receive a single confirmation message and no further messages will be sent from that Program. Opting out of one Program does not automatically opt you out of other Programs you may have separately enrolled in. If you wish to re-enroll in a Program after opting out, you may do so through the original opt-in method for that Program.

7. Help. For assistance with any Kajabi SMS Program, reply HELP to any message you receive from us, or contact Kajabi at support@kajabi.com.

8. Supported Carriers. Major U.S. carriers are supported, including but not limited to AT&T, Verizon, T-Mobile, and Sprint. Carriers are not liable for delayed or undelivered messages.

9. Privacy. Your mobile phone number, opt-in consent data, and information about your SMS interactions will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. We may share this data with service providers who assist us in delivering SMS messages (such as our telephony and communications providers), consistent with the disclosure practices described in Section 6 (Disclosure of Your Information) of our Privacy Notice. Those providers are contractually prohibited from using your information for any purpose other than delivering messages on our behalf. 10. Compliance. Your use of any Program is subject to all applicable laws, including the Telephone Consumer Protection Act (TCPA), the rules and regulations of the Federal Communications Commission (FCC), and the CTIA Messaging Principles and Best Practices. Kajabi's messaging practices are also subject to the requirements of our telephony service providers.

11. Limitation of Liability. To the fullest extent permitted by applicable law, Kajabi's liability in connection with any Program is subject to the limitations set forth in Section 6 (Limitation of Liability & Indemnification) of the Platform Terms. Kajabi makes no warranty that SMS messages will be delivered successfully or in a timely manner. SMS delivery is subject to effective transmission by your mobile carrier.

12. Modifications. We may update these SMS Terms from time to time, consistent with Section 14 (Modifications) of the Platform Terms. If we make material changes, we will notify you by posting the updated terms at this URL and updating the "Last Updated" date above. Your continued participation in any Program after such changes constitutes your acceptance of the revised SMS Terms.
