Terms & Conditions‍

These Terms and Conditions ("Terms") govern the participation of eligible Heroes in Kajabi, LLC’s (“Kajabi”) Gift Guide (the "Gift Guide"). By agreeing to be included in the Gift Guide, each Hero agrees to be bound by these Terms and the Kajabi’s policies (the “Policies”). All capitalized terms not defined herein shall have the meaning attributed to them in the Policies.

1. Eligibility; Selection Process. Only active Kajabi Heroes that use Kajabi Payments are eligible to participate in the Gift Guide.  Eligibility criteria may include, but are not limited to, offer, product, audience, pricing, reach, and engagement. Kajabi will select Heroes that best align with the Gift Guide's theme, target audience, and overall promotional strategy.  Selection is at Kajabi's sole discretion. 

2. Promotion. Kajabi will promote the Gift Guide and the selected Heroes through various marketing channels, including but not limited to, email marketing, social media, ads, and the Kajabi website.  The specific promotional activities and their duration will be determined by Kajabi, in its sole discretion.  While Kajabi will make reasonable efforts to promote the Gift Guide, it makes no guarantees regarding the reach or effectiveness of its marketing efforts or the Gift Guide.

3. Intellectual Property. Each Hero grants Kajabi a non-exclusive, royalty-free license to use their name, image, likeness, appearance, voice, Content and other intellectual property solely for the purpose of the Gift Guide.  Heroes represent and warrant that they own or have the right to use such intellectual property.

4. Liability. To the fullest extent permitted by law, Kajabi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from any Hero's participation in the Gift Guide.

5. Termination. Kajabi reserves the right to terminate a Hero's participation in the Gift Guide at any time for any reason, including but not limited to a breach of these Terms, the Policies, misrepresentation, or conduct deemed detrimental to the Gift Guide or Kajabi.

6. Miscellaneous. Kajabi reserves the right to modify these Terms at any time.  The most current version of the Terms will be available on the Kajabi website. In cases where these Terms do not address specific provisions included in Kajabi’s Platform Terms of Service, the Kajabi Platform Terms of Service will apply.
